These Terms of Service (“Terms”) govern your use of the website operated by Broughton’s Refuge, LLC (“Broughton’s Refuge,” “we,” “us,” or “our”) and the website-based services made available in connection with our supportive and transitional housing services.

By accessing or using this website, submitting an application or referral, scheduling a tour, or using a website-based feature, you agree to these Terms.

If you do not agree with these Terms, please do not use the website.

Important: These Terms are not a lease, residency agreement, admissions agreement, treatment agreement, or guarantee that housing will be available. Any approved placement or residency is governed by separate written agreements, applicable policies, house rules, and resident requirements.

1. Website Purpose

This website provides general information about Broughton’s Refuge and our housing services, including program features, housing options, eligibility information, applications, professional referrals, availability inquiries, facility tours, and ways to contact us.

Information appearing on this website is provided for general informational purposes only.

Nothing on this website constitutes legal, medical, mental-health, financial, therapeutic, or emergency advice.

Do not submit urgent or emergency requests through this website.

If you or someone else is in immediate danger, call 911.

For a mental-health crisis in the United States, call or text 988.

2. Housing Eligibility, Applications, and Placement

You must provide information that is accurate and complete to the best of your knowledge when submitting a housing inquiry or application.

Submitting an application, inquiry, referral, document, or other information does not guarantee:

  • Acceptance;
  • Eligibility;
  • Admission;
  • Placement;
  • Room availability;
  • A particular move-in date;
  • A particular room type;
  • A particular price;
  • Approval of financial assistance; or
  • Continued participation in a housing program.

Eligibility, screening, placement decisions, fees, house rules, resident responsibilities, payment requirements, and continued participation are determined under Broughton’s Refuge policies and the written agreements applicable to the particular resident.

Availability, program requirements, prices, room configurations, services, and eligibility criteria may change.

No applicant should assume that housing has been reserved until Broughton’s Refuge has expressly confirmed placement and any required agreements and payment requirements have been satisfied.

3. Applications, Referrals, and Information About Another Person

The website may allow an individual to submit information for themselves or, where permitted, concerning another person.

If you submit information about another person, including through a professional referral, you represent that you have permission, authorization, professional authority, or another lawful basis to provide that information to Broughton’s Refuge.

You are responsible for ensuring that information you provide is accurate and current to the best of your knowledge.

Submitting information about another person does not automatically authorize Broughton’s Refuge to disclose that person’s information back to you or to another organization.

Broughton’s Refuge may require a written authorization or other documentation before releasing identifiable information about an applicant or resident.

A professional referral does not guarantee placement or acceptance.

4. Contact Forms and Communications

If you provide your name, email address, telephone number, or other contact information through the website, you authorize Broughton’s Refuge to use that information to:

  • Respond to your inquiry;
  • Provide requested information;
  • Communicate concerning an application or referral;
  • Coordinate housing services;
  • Schedule or confirm appointments;
  • Follow up regarding requested services; and
  • Communicate about matters reasonably related to your interaction with Broughton’s Refuge.

We do not guarantee that every website submission, email, voicemail, or other communication will be received, reviewed, or answered within a particular timeframe.

Do not submit passwords, complete payment-card numbers, bank-account credentials, Social Security numbers, or unnecessary sensitive medical records through an ordinary contact form, email, voicemail, or text message unless Broughton’s Refuge specifically directs you to an approved method.

Our collection and use of personal information is described in our Privacy Policy.

5. Telephone Calls, Recording, Transcription, and AI-Assisted Communications

Broughton’s Refuge uses Quo for business telephone and messaging services.

Calls to or from Broughton’s Refuge may be recorded.

Recorded telephone calls may also be processed using automated or artificial-intelligence technology to:

  • Generate call transcripts;
  • Generate summaries or notes;
  • Identify follow-up information;
  • Maintain communication records; and
  • Assist staff in responding to inquiries and coordinating services.

Callers are provided notice that calls may be recorded.

By continuing a telephone call after receiving a recording notice, you acknowledge that the call may be recorded and processed as described in our Privacy Policy, subject to applicable law.

Because callers may be located in jurisdictions with recording requirements that differ from Georgia law, Broughton’s Refuge may provide recording notice even when applicable Georgia law permits recording under less restrictive circumstances.

If you do not wish to participate in a recorded telephone call, you may ask whether another reasonable communication method is available.

6. Text Messages

Broughton’s Refuge may use text messaging to:

  • Respond to housing inquiries;
  • Answer questions;
  • Follow up regarding applications or referrals;
  • Communicate concerning housing availability;
  • Provide information requested by the recipient;
  • Coordinate services;
  • Send scheduling information; and
  • Communicate with applicants, residents, family members, agencies, hospitals, referral professionals, and other persons involved in a requested service.

Providing a telephone number in connection with an inquiry or requested service authorizes us to use that number for communications reasonably related to that inquiry or service.

Providing a telephone number does not, by itself, constitute consent to receive unrelated recurring promotional text messages.

You may request that non-essential text messages stop by replying STOP or by contacting Broughton’s Refuge.

Message and data rates may apply.

7. Email Communications and Newsletters

Broughton’s Refuge may use email to:

  • Respond to inquiries;
  • Communicate with applicants and residents;
  • Coordinate professional referrals;
  • Communicate with hospitals, agencies, case managers, social workers, referral professionals, and community organizations;
  • Send information concerning housing and services;
  • Send account, lease, payment, maintenance, or appointment communications; and
  • Provide other requested information.

We may also use Kit to send newsletters, announcements, educational information, service information, and marketing communications, including newsletters directed to professional referral sources such as agencies and hospitals.

Recipients of marketing emails may unsubscribe by using the unsubscribe link included in the message.

Unsubscribing from marketing messages does not prevent us from sending necessary transactional or service-related communications concerning an application, referral, tenancy, payment, appointment, maintenance request, or another requested service.

8. Facility-Tour Scheduling

Broughton’s Refuge uses YouCanBook.me to schedule facility tours.

The scheduling system is intended for basic appointment scheduling and is not intended to collect detailed medical or resident information.

Scheduling a facility tour does not:

  • Reserve housing;
  • Guarantee availability;
  • Guarantee acceptance;
  • Create a lease;
  • Create a residency agreement; or
  • Constitute an offer of housing.

Broughton’s Refuge may send booking confirmations or appointment reminders by email or text message.

Do not submit diagnoses, medical records, medication information, Social Security numbers, payment-card information, or other unnecessary sensitive information through the facility-tour scheduling system.

9. Tenant Accounts and Innago

Residents may be provided access to an online tenant account through Innago.

Depending on the services made available, Innago may be used to:

  • Review lease documents;
  • Electronically sign documents;
  • Make housing payments;
  • Review payment history;
  • Submit maintenance requests;
  • Receive or maintain residency-related communications; and
  • Access or maintain resident documents.

Resident records stored through Innago may include items such as:

  • Lease documents;
  • Advance directives;
  • Medication lists;
  • Resident or personal-property inventories;
  • Written authorizations or releases;
  • Payment records;
  • Maintenance records; and
  • Other documents related to residency or resident services.

You are responsible for maintaining the confidentiality of your account credentials.

You must promptly notify Broughton’s Refuge if you believe your tenant account has been accessed or used without authorization.

Use of Innago may also be subject to Innago’s own terms and privacy policy.

10. Housing Payments, Refunds, and Recurring Payments

Housing payments may be processed through Innago or another payment method expressly approved by Broughton’s Refuge.

Rent, community fees, deposits, payment schedules, late fees, refunds, and other financial obligations associated with residency are governed by the applicable lease, residency agreement, payment agreement, or other written agreement.

Unless otherwise required by applicable law or expressly provided in a written agreement, housing payments that have become due and have been applied to a resident’s housing obligation are non-refundable.

Non-Refundable Housing Payments

This policy does not prevent correction or refund of a duplicate payment, payment made in error, unauthorized transaction, overpayment, or other amount that must be refunded under applicable law or the resident’s written agreement.

Any security deposit or other payment subject to specific requirements under Georgia law will be handled according to those requirements and the applicable lease or residency agreement.

Recurring and Automatic Payments

Residents who authorize recurring electronic housing payments may have payments automatically processed according to the schedule and authorization established through Innago or the applicable payment provider.

A resident who intends to move out, terminate residency, or discontinue Broughton’s Refuge’s recurring-payment arrangement must provide at least 30 days’ written notice, as required by the applicable lease or residency agreement, to allow Broughton’s Refuge to update the resident’s account and payment instructions before the following rental period.

The 30-day notice requirement is a contractual notice requirement and does not limit any rights a consumer may have under applicable law to revoke an electronic-payment authorization or instruct their financial institution to stop a scheduled electronic transfer.

Stopping or revoking an automatic payment does not by itself terminate a lease, residency agreement, or payment obligation. Amounts properly due under the applicable agreement remain payable even if automatic payment authorization is cancelled.

Residents should review their lease, payment authorization, and Innago account for applicable payment dates and cancellation procedures.

A payment is not necessarily complete merely because a payment attempt has been submitted. Transactions may be subject to processing, verification, rejection, reversal, or other action by the applicable payment provider or financial institution.

11. Donations

Broughton’s Refuge may accept donations through third-party payment processors, including Stripe and PayPal.

Donations are voluntary.

Making a donation does not:

  • Guarantee housing;
  • Affect an applicant’s eligibility;
  • Increase placement priority;
  • Create a landlord-tenant relationship;
  • Create a right to housing or other services; or
  • Influence a housing-placement decision.

Donation transactions may be subject to the terms and privacy practices of Stripe, PayPal, or another payment provider displayed at the time of the transaction.

Any representation concerning the tax treatment or deductibility of a donation will be governed by applicable law and any written receipt or information issued by Broughton’s Refuge.

12. Electronic Records and Signatures

Certain applications, leases, releases, authorizations, acknowledgments, payment documents, and other records may be completed or signed electronically.

By intentionally applying an electronic signature, typing your name where a signature is requested, selecting an electronic-signature option, or otherwise electronically executing a document, you indicate your intent to sign that document electronically.

Georgia law generally provides that a record or signature may not be denied legal effect solely because it is electronic, and an electronic signature may satisfy a legal signature requirement.

You are responsible for reviewing a document before signing it and retaining a copy for your records.

Separate leases, releases, authorizations, or other agreements may contain additional electronic-signature provisions.

13. Written Authorizations and Information Sharing

Broughton’s Refuge may communicate with hospitals, agencies, case managers, social workers, referral sources, service providers, family members, or other organizations in connection with housing placement or resident services.

When required, Broughton’s Refuge uses written authorization or a written release before disclosing identifiable applicant or resident information to another person or organization.

A written authorization may identify:

  • The individual whose information may be disclosed;
  • The person or organization authorized to receive the information;
  • The type of information that may be shared;
  • The purpose of the disclosure;
  • Any applicable expiration date or event; and
  • The individual or authorized representative providing permission.

Submitting an application or referral does not create unlimited authorization for Broughton’s Refuge to disclose all information about an applicant or resident.

Information may also be disclosed without written authorization when disclosure is otherwise permitted or required by applicable law, legal process, emergency circumstances, safety requirements, or applicable reporting obligations.

14. Acceptable Use

You agree to use the Broughton’s Refuge website, forms, scheduling systems, tenant-account features, and other online services only for lawful purposes.

You may not:

  • Use the website for an unlawful, fraudulent, abusive, or harmful purpose;
  • Knowingly submit materially false, misleading, fraudulent, or malicious information;
  • Impersonate another person or falsely represent your authority to act for another person or organization;
  • Attempt to access another person’s account, documents, records, or information without authorization;
  • Attempt to gain unauthorized access to the website, servers, databases, accounts, or connected systems;
  • Bypass, disable, interfere with, or compromise website security or authentication features;
  • Introduce malware, viruses, malicious code, automated attacks, or harmful technology;
  • Use bots, scraping tools, crawlers, or other automated systems to improperly collect website content or personal information;
  • Use the website or its communications tools to threaten, harass, abuse, unlawfully discriminate against, or intimidate another person;
  • Use information obtained through the website for fraud, identity theft, unlawful discrimination, or another unlawful purpose;
  • Interfere with website availability or operation; or
  • Violate applicable law or another person’s legal rights.

Broughton’s Refuge may restrict or suspend access to website features or online services when reasonably necessary to protect users, residents, staff, systems, property, or legal rights.

Nothing in this section is intended to prevent a person from exercising a right provided by applicable law.

15. Website Content

We make reasonable efforts to provide accurate and current information.

However, we do not warrant that website content will always be complete, accurate, current, uninterrupted, or error-free.

Information concerning:

  • Program features;
  • Housing availability;
  • Pricing;
  • Fees;
  • Eligibility requirements;
  • Room types;
  • Amenities;
  • Transportation;
  • Services;
  • Policies; and
  • Contact information

may change.

Website content does not create a contractual right to a particular room, price, amenity, service, placement date, or program unless that obligation appears in a separate binding written agreement.

Nothing on the website creates an agency relationship, fiduciary relationship, employment relationship, treatment relationship, or guarantee of housing.

16. Intellectual Property

Unless otherwise stated, original website content created or owned by Broughton’s Refuge—including text, logos, graphics, page designs, photographs owned by Broughton’s Refuge, forms, downloadable resources, and other original materials—is owned by or licensed to Broughton’s Refuge and may be protected by copyright, trademark, and other intellectual-property laws.

You may view, download, or print website information for personal, noncommercial use or legitimate purposes related to obtaining, referring someone to, or coordinating Broughton’s Refuge services.

Unless permitted by law or expressly authorized in writing, you may not:

  • Republish Broughton’s Refuge content;
  • Sell or commercially exploit it;
  • Modify it for unauthorized commercial use;
  • Distribute substantial portions of it;
  • Publicly display protected materials;
  • Remove copyright, trademark, or ownership notices; or
  • Create unauthorized derivative works from protected Broughton’s Refuge content.

Nothing in these Terms transfers ownership of Broughton’s Refuge intellectual property to a website visitor.

17. Third-Party Content and Intellectual Property

The website may display, link to, quote, reference, or embed materials owned or operated by third parties, including:

  • Images;
  • Videos;
  • Articles;
  • Maps;
  • Social-media posts;
  • Logos;
  • Forms;
  • Widgets; and
  • Other content or services.

Third-party trademarks, photographs, videos, articles, graphics, names, logos, and other materials remain the property of their respective owners.

The display or inclusion of third-party content does not transfer ownership of that content to Broughton’s Refuge.

Unless expressly stated, inclusion of third-party content does not necessarily mean that the third party sponsors, endorses, or is affiliated with Broughton’s Refuge.

Third-party materials may be subject to the provider’s own terms, licenses, and intellectual-property rights.

18. Third-Party Services, Links, and Embedded Content

The website uses or may use third-party providers for functions such as:

  • Hosting;
  • Email;
  • Analytics;
  • Advertising and measurement;
  • Telephone communications;
  • Scheduling;
  • Tenant management;
  • Payment processing;
  • Donations;
  • Maps;
  • Social-media functionality; and
  • Embedded media.

Third-party services currently used may include Hostinger, Hostinger Mail, Google Analytics, Meta/Facebook, Kit, YouCanBook.me, Innago, Quo, Stripe, and PayPal.

Third-party websites and services are governed by their own terms and privacy practices.

The website may also contain embedded content from other websites, including videos, images, articles, maps, social-media posts, forms, or interactive features.

Embedded content may operate as though you visited the third-party provider’s website directly. The provider may receive information about your device, browser, IP address, or interaction with the embedded content and may use cookies or similar technologies.

Broughton’s Refuge does not control the independent privacy, security, availability, or content practices of third-party providers.

Links to third-party websites are provided for convenience and do not necessarily constitute endorsement.

19. Cookies, Analytics, and Advertising Technologies

The website may use cookies and similar technologies, including Google Analytics and the Meta/Facebook Pixel, for website analytics, advertising measurement, audience analysis, and related purposes.

Information about these technologies, the information they may collect, and available privacy choices is provided in our Privacy Policy and, where applicable, through website cookie or privacy-choice controls.

The website should not be used to intentionally transmit sensitive resident documents, medication information, medical records, Social Security numbers, or complete financial credentials to analytics or advertising providers.

20. No Guarantee of Housing or Services

Neither:

  • Completing an application;
  • Submitting a professional referral;
  • Providing documents;
  • Participating in a telephone screening;
  • Speaking with staff or an automated telephone assistant;
  • Scheduling or completing a facility tour;
  • Being referred by an agency or hospital;
  • Creating an online account; nor
  • Making a payment that is later rejected, reversed, or refunded

by itself guarantees housing or placement.

Placement may depend on eligibility, availability, applicable program requirements, completed documentation, payment obligations, and execution of required written agreements.

Any final residency arrangement is governed by the applicable lease, residency agreement, program agreement, house rules, or other written documents—not these Website Terms alone.

21. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website and its content are provided on an “as is” and “as available” basis.

Broughton’s Refuge does not make warranties, express or implied, concerning:

  • Merchantability;
  • Fitness for a particular purpose;
  • Non-infringement;
  • Accuracy;
  • Website availability;
  • Error-free operation; or
  • Freedom from viruses or other harmful components.

We do not guarantee that the website will always be available, uninterrupted, secure, or free from technical problems.

This section does not limit rights or protections that cannot lawfully be waived.

22. Limitation of Liability

To the fullest extent permitted by applicable law, Broughton’s Refuge and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating solely to use of, or inability to use, this website.

To the extent liability relating solely to use of the website cannot lawfully be excluded, Broughton’s Refuge’s total liability will be limited to the amount paid, if any, specifically for use of the website during the six months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

Nothing in this section changes obligations or remedies created under a separate lease, residency agreement, payment agreement, or other written contract.

23. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Broughton’s Refuge and its owners, officers, employees, contractors, and agents from claims, liabilities, damages, losses, and reasonable expenses arising from:

  • Your unlawful or unauthorized misuse of the website;
  • Your material violation of these Terms; or
  • Your violation of another person’s legal rights.

This section does not apply to the extent a claim results from conduct for which indemnification may not lawfully be required.

24. Privacy

Our collection, use, retention, and disclosure of personal information is governed by our Privacy Policy.

The Privacy Policy includes additional information concerning:

  • Applications and referrals;
  • Tenant records;
  • Quo telephone recording and AI-assisted features;
  • Innago;
  • Housing payments;
  • Stripe and PayPal donations;
  • Kit newsletters;
  • YouCanBook.me;
  • Google Analytics;
  • Meta/Facebook Pixel;
  • Embedded content;
  • Cookies;
  • Written information-sharing authorizations; and
  • Privacy choices.

The Privacy Policy is incorporated into these Terms by reference to the extent applicable to use of the website and related services.

25. Governing Law and Venue

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

Any dispute relating specifically to these Terms or use of the website will be brought in the state or federal courts located in or serving DeKalb County, Georgia, unless applicable law requires another jurisdiction or forum.

This provision does not override a different dispute-resolution or venue provision contained in a separately executed lease, residency agreement, or other binding agreement.

26. Changes to These Terms

Broughton’s Refuge may update these Terms when website features, business practices, service providers, or legal requirements change.

The updated Terms will be posted on this page with a revised Last Updated date.

Where required by applicable law, additional notice will be provided concerning material changes.

Continued use of the website after revised Terms become effective constitutes acceptance of the revised Website Terms to the extent permitted by law.

Changes to these Website Terms do not automatically modify an existing lease or other separately executed agreement.

27. Severability

If a provision of these Terms is held invalid or unenforceable, that provision will be interpreted or limited to the extent necessary to make it enforceable where permitted, and the remaining provisions will continue in effect.

28. Entire Agreement Regarding Website Use

These Terms, together with the Privacy Policy and any documents expressly incorporated into them, constitute the agreement between you and Broughton’s Refuge concerning your use of this website and its website-based features.

These Terms do not replace a lease, residency agreement, release, payment agreement, house rules, or another separately executed agreement between Broughton’s Refuge and an applicant or resident.

If a separately executed agreement governs a particular housing, payment, or residency matter, that agreement controls that matter according to its terms.
